1) Overview

These website Terms of Use (“Terms”) govern your access to and use of websites, apps, and online services operated by Caribou Digital (UK) Limited and its subsidiaries and affiliates (together, “Caribou”) that link to these Terms (the “websites”). By using a website, you agree to these Terms.

“Caribou” means Caribou Digital (UK) Limited and its subsidiaries and affiliates. Caribou Digital (UK) Limited is registered in England & Wales (No. 09241564), Wey Court West, Union Road, Farnham, Surrey, GU9 7PT. 

Our use of your personal data is described in our Privacy Policy and Cookie Policy. If a particular website, product, or service has its own terms, those will apply in addition to (or, where stated, instead of) these Terms.

Except for the limited licence above, no rights are granted. Caribou names and logos are trademarks; third-party marks remain the property of their owners.

9) Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law. Subject to the foregoing, Caribou will not be liable for any loss or damage (whether in contract, tort, negligence, or otherwise) arising from or in connection with use of, or inability to use, the Websites; or reliance on any content; including indirect, consequential, special, punitive, or exemplary losses, and loss of profits, data, or goodwill.

10) Indemnity

You agree to indemnify and hold harmless Caribou from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or misuse of the websites.

11) Linking to the Websites

You may link to our home page in a way that is fair and legal and does not damage our reputation or suggest any association, approval, or endorsement where none exists. You must not frame the websites without our permission, and we may withdraw linking permission at any time.

12) Termination

We may suspend or terminate your access to the websites immediately if we reasonably believe you have breached these Terms or applicable law.

13) Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction. Mandatory consumer protections in your country of residence (if applicable) are unaffected.
